The Need for the Law of Treaties, VCLT Scope, & Limits ⚖️

What is a Treaty? 📜
A treaty is a formal, written agreement between two or more states or international organizations. These agreements create binding legal obligations and are a cornerstone of international law. Treaties can cover a wide range of topics, from trade and human rights to peace and environmental protection.

Why Do We Need Laws for Treaties? 🌐
Just like domestic contracts, treaties require a legal framework to ensure they are created, interpreted, and enforced fairly. The law of treaties provides rules for:

The Vienna Convention on the Law of Treaties (VCLT) 🤝
The VCLT is the primary international treaty that codifies the law of treaties. Adopted in 1969, it is often referred to as the "treaty on treaties." It provides a comprehensive set of rules and principles for states to follow when making and interacting with treaties.

VCLT Scope & Limits ⚠️
While the VCLT is incredibly important, it has specific limits:

Written Agreements Only: It only applies to written treaties between states.

Retroactivity: It generally does not apply to treaties concluded before it came into force in 1980.

Customary Law: The VCLT largely reflects customary international law, meaning many of its principles apply even to non-parties. However, some of its provisions are specific to the convention itself.
