SUBOXONE
Suboxone, a prescription drug utilized for opioid addiction treatment, has been available as a pill for some time. However, its newer sublingual film version, which dissolves in the mouth, introduced a few years ago, has sparked significant legal controversy.
Daily use of Suboxone's dissolvable film has been linked to rapid and severe tooth decay, leading to cavities, tooth loss, and other dental issues, so much so, as we talk about below and the video explains, that they had to change the warning. The lawsuits contend that the makers of Suboxone were aware of these side effects but chose not to inform doctors and patients, prioritizing profits over safety. Consequently, many individuals have suffered painful dental damage, necessitating costly dental procedures.
FAILURE TO WARN
Despite being aware that the sublingual version could cause acute tooth decay, initial releases of Suboxone did not include warnings about this risk on the drug label. It wasn't until after the FDA issued a public safety warning in January 2022 about tooth decay risks associated with Suboxone that the manufacturer updated the label to include this information.
In response to these issues, a surge of Suboxone tooth decay lawsuits commenced nationwide in 2023, alleging that the manufacturer negligently failed to warn users about the risk of tooth decay.
MDL
These lawsuits were eventually consolidated into a class action Multidistrict Litigation (MDL) in the Northern District of Ohio early this year. This is a good development for victims' who now have a team of lawyers working together. An MDL streamlines the handling of complex cases by transferring individual lawsuits with common factual questions to a single district court for pre-trial proceedings. This process differs from a class action by allowing each case to remain separate, potentially leading to individual trials or settlements and providing tailored outcomes for plaintiffs.
As of February 2025, the Suboxone MDL has over 896 pending cases, with more than 10,000 more covered by a tolling agreement. Our law firm continues to get flooded with new case as awareness spreads. The litigation's early stages are focused on establishing a consolidated discovery plan, followed by selecting a few cases for bellwether trials to aid in reaching a global settlement.
SETTLEMENTS
Regarding compensation, while it's challenging to predict exact amounts, there's a potential for punitive damages in trial cases, possibly leading to multimillion-dollar payouts. Juries have the ammo to get very angry about what the defendants did.
But settlements... they are a compromise. Most settlements are anticipated to range from $30,000 to $150,000, determined by a points system that assesses the severity of dental injuries, treatment costs, and the overall impact on the plaintiff's life. This system ensures that those with more severe injuries may receive higher settlements. That is just our guess... it is hardly a sure thing on the high or low end.
The resolution of this litigation through a global settlement before reaching trial is a possibility lawyers are considering, as it could offer a faster route to compensation for those affected.
