Article 15 of the Indian Constitution is a fundamental right that ensures equality and prohibits discrimination on specific grounds. It states that the State shall not discriminate against any citizen based on religion, race, caste, sex, or place of birth. Additionally, it prohibits restrictions on access to public places such as shops, restaurants, hotels, and places of entertainment, as well as the use of public wells, tanks, and bathing ghats.
However, Article 15 also allows for special provisions to promote social justice and upliftment. It enables the State to make affirmative action policies for women, children, and socially and educationally backward classes, including Scheduled Castes (SC) and Scheduled Tribes (ST). This provision forms the constitutional basis for reservations in education and employment to ensure equal opportunities for historically disadvantaged groups.
