UPDF AMENDMENT BILL EXPOSED: MEGO ARYEM ON HOW IT WILL BE USED AHEAD OF ELECTIONS | M7 | NRM | NUP

On Tuesday, 20th May 2025, Parliament passed the Uganda Peoples’ Defence Forces (Amendment) Bill, 2025, which allowed civilians to be tried in courts martial under clearly defined and exceptional circumstances. The Bill introduced wide-ranging reforms to the military justice system, including the establishment of a Directorate of Military Prosecutions, restructuring of health services for armed forces personnel, improved management of veterans’ affairs, and safeguards against the premature execution of death sentences before confirmation by the Supreme Court. It also set out a clear appeals process from lower courts martial up to the Supreme Court. The Minister of Defence and Veteran Affairs, Hon. Jacob Oboth, stated that the law targeted civilians involved in military-related offences and was not intended to subject ordinary citizens to military courts arbitrarily.

The joint Committee on Defence and Internal Affairs supported the Bill but emphasized that the trial of civilians in military courts should occur only in exceptional cases and with full guarantees of a fair trial. The committee recommended reforms to strengthen independence and transparency in military courts, including clearer separation of judicial and prosecutorial roles, increased civilian oversight, and the administration of judicial oaths for military judges appointed through the Judicial Service Commission. It further proposed that appeals from the General Court Martial should lie with the Court of Appeal and called for regulation of military-style attire. Despite opposition walkouts, Parliament passed the Bill while formally noting concerns regarding oversight and accountability within the military justice system.
