The smell of marijuana, by itself, is not probable cause for police to search your vehicle. This is a recent 5-1 ruling by the Michigan Supreme Court.
If police want to search your car they need a warrant or a warrant exception. Until now, the smell of marijuana.
na was one of those exceptions. This ruling overturns a 25 year precedent.
Police can combine the smell of marijuana with other factors to amount to probable cause for a search, but the smell alone is no longer enough.
