By an Appellant’s Notice, filed on 23 October 2024, the Appellant appeals the Orders dated 31 July 2024 and 18 October 2024 of Mr Justice Picken sitting as a High Court Judge in the Commercial Court, in which the Judge terminated the Defendant’s right to lease each aircraft and ordered that the Defendant had no benefit or rights to the aircraft and made a costs order.
The dispute relates to the issue of contractual liability regarding a purchase agreement between the parties for the purchase of an airline.
The first day of the hearing will hear an application for an order imposing a condition, pursuant to CPR 52.18(1)(c), that the pursuit of these appeal proceedings be conditional on the Appellant complying with the Order of Mr Justice Picken dated 2 May 2025. The full appeal will commence on Tuesday 20 May.
