Hi, my name is Bryant Fitts. I'm a lawyer in Houston Texas. We handle large injury claims and large insurance claims across the nation.
I've had many, many questions lately from small business owners. And one of the most glaring questions I'm getting on a daily basis is, "Hey, the city, or the state, or the country shut me down. They said my people can't come to work and here I am losing money by the day, by the minute, by the hour, and I have to pay rent, I have all my overhead, but I can't sell what I want to sell or what I normally sell. So can I make a claim under my insurance policy for business interruption?"
Well, the answer is, "Maybe". And I know you hate to hear that, but that's how lawyers have to answer a lot of questions. If you have Business Interruption coverage, in this circumstance, you want to make sure you have a clause in your policy that would allow a claim to be made if a civil authority, which a civil authority would be a state, a local government, county, if they shut down the area, and we have to look at the language which the policy says, then you may have coverage.
There are a few other items in your policy that need to be looked at, but if you're concerned ... If you have coverage based on something that the city, or the state, or the county is requiring you to do or not do, that's where you look in your policy. Now you also may have a Virus exclusion which could prevent you from having a covered claim.
