In South Africa – a court can grant parties with a divorce provided that they can show the marriage relationship has broken down, with no reasonable prospect of a normal marriage relationship.

There are factors to consider when looking at an irretrievable breakdown of a marriage:

1. Lack of meaningful communication
2. You have tried to reconcile
3. Domestic Violence
4. Spouse has left the home and has not returned
5. Spouse committed infidelity
6. Cyber – Relationships

Section 4 of the Divorce Act mentions further grounds you can use:

1. Where you and your spouse have lived apart for a continuous period of 1 year
2. Adultery
3. Spouse is a criminal
