Cheque Bounce Case Shall be Dismissed On Invalid Notice | Notice 138 NI Act | Cheque Dishonour | Legal Gurukul

This cheque bounce case judgement (138 ni act) supreme court gives a new rule regarding the mandatory legal notice. The supreme court held that the legal notice in a cheque bounce matter must contain the cheque amount specifically and if other amounts are also mentioned like interest, cost then every such amount should be breakup and specifically mentioned. A cheque legal notice will be vauge and invalid if it does not mention the cheque amount specifically.

In this cheque bounce case, the legal notice did not mentioned the cheque amount specifically therefore the supreme court held that the demand notice was invalid and therefore the cheque bounce case under 138 negotiable instrument act (138 ni act) is not maintainable. Thus the supreme court quashed the cheque bounce case.
