The original application submitted to Birmingham City Council proposed single-storey side and rear extensions, a replacement roof with gable ends, and a rear dormer window. Unfortunately, the council refused the scheme. Their objections were based on several concerns: the scale and design of the dormer, the impact on the character of the surrounding street, and the potential harm to neighbouring amenity. Instead of a bulky flat-roofed extension spanning the full rear elevation, the new dormer was repositioned within the main roof slope, aligning with neighbouring extensions and eliminating issues of scale, overshadowing, and visual dominance.

Alongside these design revisions, we submitted strong supporting evidence, including photographs, annotated diagrams, and a shadow analysis to prove compliance with Birmingham’s local planning policies. Our planning statement clearly demonstrated that the proposal respected the 45 Degree Code, safeguarded neighbouring outlook, and preserved natural light. By directly referencing local and national planning policies, supported by precedent cases, we built a compelling case that addressed all previous refusal reasons.

As a result, full planning permission was granted. The approval came with standard pre-commencement conditions such as material samples and a construction management plan – common requirements for this type of development and nothing that would delay progress.

This case highlights an important lesson for anyone who has received a planning refusal: rejection does not mean the end of your project. In many cases, an appeal is not the most effective next step. Instead, by making targeted amendments and providing a robust planning justification, it is possible to achieve approval without entering into lengthy appeal processes.
