Attorney DelSignore is known throughout Massachusetts for defending OUI cases. In this video I want to discuss Cambridge district Court in particular. So some of the things I look for in an OUI charge are the following. So how do you decide what the best way to handle the case is? Whether you should take a plea, resolve it. Let's assume you're charged with a first offense. What I look for, number one, first thing I'll look for and I'll discuss with you is the driving. How serious is the driving infraction? Is it a major infraction? Did you get into an accident? Are people calling 9 1 1 on you? Are these people likely to testify? Did you cross the mark lanes? And if you cross the mark lanes, was it once, twice?

What was the significance of it? Because people cross the mark lanes all the time, doesn't mean you're under the influence of alcohol. So we want to look at the driving and see can we minimize it? Now, speeding, for example, is not assign of somebody under the influence. So if you stop for speeding, say 20, 25 miles an hour, even over the limit, it's not a big indicator of somebody under the influence of alcohol. So really the big one is really the mark crossing the center line. That's really the biggest one because you could get into a head-on crash and that's more serious driving. But you often see in a report that you cross the so-called fog line and people cross that one all the time because really it is no big deal. You hit it, you come back, there's no one over there. It's a breakdown lane.

So I'll look at the driving and try to suggest that it's a quick violation. It's momentary, it's insignificant, not reflective of somebody who's had too much to drink. What happens if you crashed or in an accident? Then we're going to take other parts of the case and focus on them. We'll focus on the lack of evidence that the fact that it's subjective and accidents do happen and they're not always related to alcohol. So we want good driving, but sometimes we don't have that. There's still a way to defend the case where we will focus on the strength of your case. We'll talk about the observations, we'll talk about the lack of evidence and the fact that the office had very little opportunity to observe you if you were in a crash and you may have been injured and some of these signs might relate to an injury instead of you being under the influence of alcohol.

Next, I look at how do you interact with the officers? So officers, when they write these reports, they're looking for every little action it could be assigned, you're impaired. That's how they're taught in their training. So even with the driving, for example, once the blue lights come on, officers are taught that somebody who's not under the influence is going to pull over safely immediately. So we look, does the officer mention anything about the pullover in your report? If there is no mention of that, that means that's something you did, right? That's just kind of a little trick when you read police reports is we're always looking for what's not in the report more so than what's in it. We know all the bad stuff is going to be in the report. How do we find the good stuff? Well, I know that because I've questioned hundreds of officers, I probably cross examine two to three offices a week, and I know how they respond to these questions.
