On September 8,2025, the Hon'ble Supreme Court of India reserved its judgment in a landmark case concerning the payment of Dearness Allowance (DA) to West Bengal Government employees.
The West Bengal Government argued that DA is not a fundamental entitlement under the Constitution and that there is no uniform rule across India regarding its disbursement.
In contrast, employee unions asserted that DA is a legitimate expectation and an essential part of fair compensation, demanding that it be calculated using the All India Consumer Price Index methodology.
The Supreme Court is now tasked with deciding whether the right to receive DA qualifies as a fundamental right.
