The Supreme Court of India ruled that State Bar Councils (SBCs) cannot charge enrolment fees beyond the amount prescribed under Section 24(1)(f) of the Advocates Act, 1961, as it violates the principles of equality and reasonableness under Articles 14 and 19(1)(g) of the Constitution.
The ruling will take effect prospectively, meaning SBCs are not required to refund excess fees collected prior to this judgment but must comply with the stipulated fee structure moving forward.
