'No Evidence': Brian Walshe's Lawyer Larry Tipton Urges Acquittal In Closing Argument

In most jurisdictions, prosecutors argue before the defense, then can rebut the defense's argument. In Massachusetts, the defense argues first, then prosecutors, and there is no rebuttal.

That's what happened this morning in Norfolk County Superior Court in Dedham for the trial of Brian Walshe, who is accused of murdering his wife, Ana Walshe, on Jan. 1, 2023.

Defense attorney Larry Tipton argued for almost an hour today (Friday, December 12, day 10) . His defense is that Walshe disposed of his wife's body and lied to police, but he didn't kill her and instead panicked when she died unexpectedly of natural causes.

According to an artificial intelligence-generated summary of his argument, the defense "argued that there is no evidence of premeditated murder. They highlighted that Walshe had no motive, such as an affair or financial concerns, and that his actions were driven by fear and confusion. The defense pointed to his loving relationship with his wife and children. They emphasized that Walshe's internet searches and disposal of items were consistent with his state of disbelief and panic, not premeditation. The defense also argued that the physical evidence, such as blood stains, was inconsistent and did not support a murder charge."
