Real estate transactions don’t usually fail because of a single dramatic mistake: they unravel through small oversights that only become obvious once litigation begins. In this course, Steven W. Blake and Elaine Huang of Blake Law Firm draw on years of experience representing buyers, sellers, brokers, and investors in real estate disputes to examine how common transactional missteps turn into costly lawsuits. Using real-world examples from both residential and commercial deals, they explain why issues that seem minor during escrow often determine the outcome once a dispute reaches court.
Blake and Huang walk through the recurring problem areas they see most frequently in litigation, including disclosure failures, title and encumbrance issues, contingency breakdowns, contract interpretation disputes, and dual agency conflicts. They also explore how unclear documentation, informal communication, and poorly drafted repair addenda can undermine otherwise solid transactions. By reframing these issues through the lens of courtroom outcomes, this program highlights how attorneys can better spot risk early, advise clients more effectively during transactions, and reduce the likelihood that a deal will end in prolonged, expensive litigation.
