Peter Freeman CBE QC (Hon), a former Chairman of the UK Competition Commission and a former Chairman of the UK Competition Appeal Tribunal, current Member of the CAT.

While the UK competition law regime shares many features with EU competition law, it also has numerous distinct characteristics. To better understand its history, institutional framework, recent developments, and current challenges, I’ve invited one of the most influential thinkers and practitioners in the field — Peter Freeman CBE QC (Hon), former Chairman of the Competition Appeal Tribunal (CAT). In this conversation, Peter Freeman offers a number of eye-opening insights into the functioning of UK competition law, focusing in particular on:

🔍 The position of the Competition Appeal Tribunal (CAT) within the overall UK judicial system
🔍 The growing caseload of the CAT Private enforcement before the CAT: Too little or too much?
🔍 Stand-alone and follow-on actions
🔍 The role of economics in UK competition proceedings: yesterday, today, and tomorrow
🔍 Settlements in private actions
🔍 The standard of review in private enforcement cases
🔍 The interpretation of economic evidence: economics and objectivity
🔍 Expert debates during proceedings at the CAT
🔍 The role of ministerial discretion in UK competition law
🔍 Relationship between the CMA & the Government
🔍 History of UK competition law
🔍 Competition & Growth
🔍 Relationship between the DMCCA & existing UK competition law
🔍 Enforcing effectively the DMCCA in the current economic & political climate
🔍 How much of CMA discretion is needed (and will be tolerated) for the effective enforcement of the DMCCA
🔍 How litigious the DMCCA regime will be

In the next episode (No. 116, to be released next Tuesday) we publish a conversation with Mikaël Hervé, a vice president in Charles River Associates’ European Competition Practice focusing on the mechanics of online advertising and the latest AdTech cases.

In the previous episode (No. 114, released last Tuesday) we had a conversation with Prof. Nicolas Petit, Professor of Competition Law and Head of the Department of Law at the European University Institute (EUI). The video is available here:    • Nicolas Petit: Goals of Competition Law | ...

The Digital Markets Research Hub is an independent academic initiative aiming at scrutinising the functioning of competition/regulation in digital markets. We host one-to-one interviews with leading policymakers, regulators and practitioners. We also organise online mini-workshops inviting high-profile experts and academics in various fields of digital competition law & policy to discuss the most vibrant issues of the ongoing regulatory reforms in digital markets. While having our clear normative stand on the matters discussed within the hub, we value different views and invite relevant stakeholders and thinkers representing the whole spectrum of reasonable positions on how to regulate competition in digital markets. All our materials are available at YouTube channel, which you are very welcome to subscribe to. This interview is organised & conducted by Prof. Oles Andriychuk, School of Law, University of Exeter.
