Simon Line Trademark Dispute | MVP vs Essential Discs

MVP Disc Sports and Essential Discs are currently involved in a trademark dispute over use of the name “BALANCE” for disc golf discs. MVP filed a trademark application for the name “BALANCE” late last year. In May of this year, Essential Discs got PDGA approval for their own mold called the “BALANCE” and has been using the name in commerce for more than five months. Just recently, MVP released a statement on their website that included some misleading and even flat out false information regarding their trademark application. We wanted to clear up some of the most common misconceptions we’ve been seeing and lay out the facts of the situation. This case illustrates how important a well thought out intellectual property strategy is for securing your business’ future and avoiding expensive mistakes.
