Article 19 (1)(g) of the Constitution guarantees to all citizens, the right to practice any profession or to carry on any occupation or trade or business. This freedom is also not absolute and clause (6) of the Article authorizes legislation which (i) imposes reasonable restrictions on this right in the interest of the general public; (ii) prescribes professional or technical qualifications necessary for carrying on any profession, trade or business and (iii) enables the State to carry on any trade or business to the exclusion of private citizens wholly or partially.
In this presentation, an attempt would be made to explain the various aspects of the right guaranteed under Article 19(1)(g) and the restrictions that can be imposed on this right under clause (6) of Article 19.
