Prosecutorial Misconduct: What Should You Know?
It’s very difficult to plead guilty to a crime, especially if you did not knowingly break the law. Prosecutors may offer a plea agreement that limits the sanction. Or, the plea agreement may result in prosecutors not bringing charges against a family member.
The alternative to accepting a plea agreement would be to litigate through trial. By litigating through trial, a defendant may force the government to prove its case.
Government prosecutors may or may not be truthful. If they withhold exculpatory evidence, they’re partaking in prosecutorial misconduct. And prosecutorial misconduct can result in dismissal of charges, or reversible error in trial.
As a defendant, you should know that many lawyers believe that prosecutorial misconduct is not aberration. It’s a regular course of action. They may put pressure on people to say what they need them to say in order to sustain a conviction.
