Pakistan’s judiciary is facing one of its most significant constitutional challenges following the 27th Amendment, which created the Federal Constitutional Court (FCC) and shifted appellate powers away from the Supreme Court. Five Islamabad High Court judges have petitioned the FCC, contesting the transfer of their intra-court appeal from the Supreme Court and arguing that Parliament cannot weaken judicial independence by reallocating core powers. The amendment also permits the transfer of judges without consent — a move they say exposes the judiciary to pressure. Protests are growing nationwide, with Karachi Bar Association staging demonstrations against the FCC and expressing solidarity with Supreme Court judges who resigned in protest. As legal strikes continue, the FCC must now decide whether it can hear the judges’ appeal.
