IEEPA and Tariffs: Emergency Powers, Trade Policy and What Comes Next

UPDATE: A federal court has ruled that President Trump’s proposed tariffs under the International Emergency Economic Powers Act (IEEPA) exceeded presidential authority. On May 28, 2025, the U.S. Court of International Trade found that IEEPA does not permit the president to impose sweeping tariffs without congressional involvement or procedural review. However, the very next day, the U.S. Court of Appeals for the Federal Circuit issued a temporary stay—meaning the tariffs remain in effect while the appeal is underway.

This legal back-and-forth highlights why understanding IEEPA is more important than ever.
