sir states of aids admitted in evidence based on the admission and the evidence the stakes is evident the court is going to find that the alleged father in this case mr everett cannot be excluded as the biological father of the child journey based on that finding i'm going to make the finding that mr everett is the biological and legal father of the child so he is the father of that's what the dna test results show yes ma'am okay may i perceive your honor okay thank you i'd like to call miss randall you state your name please yes ma'am my name is deja randall as your churchill randall and you're the mother of journey tracy everett is that correct yes ma'am and um the state of texas presumes that you and mr albert will be known as joint managing conservators with you having the right to establish where the child lives um that basically means that y'all share rights that you think a parent would have um do you think that would be in the best interest of this child um yes um i feel like it i feel like she deserves to know who her father is and you know yeah and you you don't have any problem with um when he has the child taking the child to the doctor and going to school functions and things like that correct correct i don't have a problem with it okay um and um has mr average been visiting with the child has a child gone to see him um yes uh he he does um come see journey from time to time he does and his journey ever gone um with him or has all those visits been with you as well no every time um she every time he sees her i'm there it is he's never you know seen her they never went anywhere to you know by themselves or anything like that okay state standard visitation basically provides that he would have visitation on the first third and fifth weekends of the month with some alternate holidays and some summer visitations um do you think that would be in the best interest of journey yes yes and since since he's gotten to know her with you do you feel there's any reason he should have any um continued supervised visitation or can she go ahead and go with him um she can but i have an issue the issue is that i haven't um i would like to know where she you know if she leave with him today or tomorrow i would like to meet the i would like to know who is he bringing her around and stuff like that because i don't all i know is him i don't know his family or anything like that he don't know my family so i would like to that's something i would like to know okay um well the court won't be able to to restrict him from that but maybe you and him can discuss it and you can meet me meet his family so you'll feel more comfortable um and you and he both reside in jefferson county in this county there is a restriction that the district judges have put in place that as long as the child is residing with you you either need to stay here in jefferson county or you can move to any of the counties that are next to jefferson county but if you want to move further away then um you would either need to discuss that with mr average or go back to the court and ask for a motion to modify to lift that restriction i'm in the process of moving right now um but um it's not in jefferson county is um it's actually in uh harris county um is that okay for me to do that uh um oh that's not okay it's not okay no man it's not okay i mean you could you can discuss that with mr everett and if he's okay with it then then y'all can agree to that but but in the order they'll have the restriction and if if you don't if he doesn't agree it will be a violation of the of the order um now do you how is this child currently covered for insurance uh she receives medicaid she's on medicaid okay and um do you have any personal knowledge of uh mr average wages um i he showed me a few of his check stubs a few just maybe three at the most and um i that was like a month ago okay so he would be the best person to ask about that yes he he will be the best person not me okay and do you do you know how many other children he may have under the age of 18 besides journey um if i'm maybe two um because i don't this is some stuff that i don't know um so maybe two now are you asking for back child support um no i don't want to do the back child support because he said he cannot afford to do the backdrop support okay um so so but.................
