Typically, after the parties have met ((26(f) Conference) and agreed on issues concerning the litigation, they meet with the Judge. At the meeting, the Judge will sign a Scheduling Order. The Order outlines the management of the lawsuit. The time discovery commences and the time it ends are stated in the Order. But, F.R.C.P. 56(b) permits a party to file a motion for summary judgment at any time until 30 days after the close of all discovery. This Video addresses the instance when a party files a motion for summary judgment before discovery commences and before discovery ends. And the non-moving party's right to object and how to object.
