My name is Sheri Abrams and I am an attorney in Fairfax Virginia. In today's video, we will be talking about social security disability. We will also touch briefly on SSI and adult disabled child benefits.

There are 3 types of social security disability programs that are available to different people. The first is social security disability program itself, or SSDI. The second is supplemental security income, or SSI. The third is adult disabled child benefits, or DAC.

SSDI is for people who have worked, and have worked in the right period of time. The majority of people who qualify have worked 40 quarters. If you're 30 years old or older, you need 40 quarters (or 10 years) of solid work. You also need to have worked 5 of the last 10 years. All of these things will determine whether or not you are able to qualify for benefits. The key to social security disability is that you are unable to do any work in the national economy, and have been examined by a treating doctor who is a specialist in what your ailment is. There are a lot of great benefits to SSDI, which you will learn about in this video.

Supplemental security income, or SSI, has 2 phases. One is for children under 18 years old, and one is for adults or individuals over 18 years old. The amount you can get from SSI is limited to $735 per month, which increases periodically. The key for a child under 18, is that the income of their parents are taken into consideration when determining if the child qualifies. SSI is a needs based program. If the parents of the child are working, the child will not qualify for SSI even if they are extremely disabled. As soon as the child turns 18, however, Social Security considers them their own person, which means they will not have deeming from the parent to them. This means they can receive SSI if they have less than $2000 in their name. With this said, the requirements to get supplemental security income are the same as SSDI. You need to be able to prove you are unable to do any work in the national economy. This is why you will need a written report from your specialist doctor confirming your inability to work in the national economy.

A disabled adult child (DAC) benefit will come into play if your disabled child was disabled before they turned age 22. They can then receive benefits based on their parent’s benefits. The SSI amount is typically limited to $735 per month. This is not very much money to live on. If the child was disabled before the age of 22, and a parent retires or passes away, the child will get a portion of that parent's benefits. This portion will not be subtracted from the parent's benefit. If a parent retires, the child will get 50% of what the parent receives. If the parent passes away, that amount increases to 75%. The best thing about the disabled adult child benefit, is that there is no $2000 limit like with SSI. There are benefits to this, but also some disadvantages to this, which is why I always recommend setting up a Special Needs Trust along with getting these benefits. After 24 months, the child will receive Medicare. All you need to do to get these benefits is ask at the local social security office when you go in for retirement or when you're processing a deceased individual's benefit. However, you need to plan when you retire taking this into consideration. Some people retire at 62, and they get partial social security retirement. Some people retire at 70, and they get the most social security retirement. You need to plan when the best time to retire for you is, so you can maximize the amount you and your disabled child can receive.
