For instance, in the example I spoke about earlier, it took our client 2 years to settle because after her surgery, she was required to receive physical therapy but complications occurred that required additional treatment options. This played a major role in settlement negotiations because we wanted to make sure our client was compensated fairly for her injuries.
Now, to further illustrate why some rear end collisions take longer to resolve, let’s examine the example I have been talking to you about. Initially, the insurance company only offered our client 30K settlement for her injuries. It is very common that the first offer by the insurance company is a low ball offer that you should never consider. If she had accepted their initial offer, she would have missed out on a 10X increase in her settlement.
By fighting the collision claim, we were also able to attack the driver’s uninsured motorist provision to maximize her recovery. Remember, she was a passenger in the car so we were able to determine settlement from both the driver of the 18 wheeler but also the driver of the car she was in as well.

2. Did you go to the hospital? If you were transported to the hospital, as a general rule, the insurance company will offer a more generous settlement.
3. Is the insurance company of the at-fault driver a decent company?
4. Are you the only person making a claim on the insurance? If there were other passengers or individuals involved in the car accident that could make a claim against the available coverage, the insurance company may be quick to settle with you.
