The Trump Administration recently issued an executive order attempting to exclude from the benefits of birthright citizenship children born in the United States to parents unlawfully here or to parents temporarily visiting. It has long been assumed that the Constitution's grant of birthright citizenship applies to these groups because they are "subject to the jurisdiction of the United States" when born. Is the Administration's EO unconstitutional? What does the phrase "subject to the jurisdiction" mean? What is the historical support on either side of the question?
