URGENT LEGAL UPDATE: Major Changes to Thai Sexual Offence Laws in 2026

It’s 2026, and the legal landscape in Thailand has shifted radically, particularly regarding sexual offences. Penal Code Amendment No. 30 came into force on December 30, 2025, and it is not a minor update—acts previously dismissed as "banter" or minor nuisances are now serious crimes with potential prison sentences.

Key Changes You Must Be Aware Of:

Rape Definition Expanded: The law is now gender-neutral and strict. Oral sex, object penetration, and forcing a victim to penetrate the offender are now legally classified as rape. Marital rape is also explicitly criminalized with no exceptions for spouses.

Sexual Harassment is Now a Criminal Offence: For the first time, harassment is a specific crime. This includes acts that cause annoyance, shame, or fear without physical contact—such as catcalling, intrusive staring, stalking, or sending lewd messages online.

Digital Footprints Matter: Sending unsolicited lewd pictures or sexually charged comments on Line, WhatsApp, or social media is now punishable by up to three years in prison.

Indecent Acts vs. Harassment: Any unwanted sexual touching (groping, grabbing, hugging) is classified as an "Indecent Act," a severe offence carrying up to 10 years in prison.


Zero Tolerance on Bullying: Section 397 has been updated to cover general bullying or intimidation that causes persecution, shame, or annoyance.

Deportation Risks: If you are sentenced to 30 days or more, you face deportation and blacklisting from Thailand.
