👉 What was the case about?
Two retired government officers (a Circle Officer and a Talathi) were accused of facilitating fraudulent property transactions way back in 1996 by certifying mutation entries based on forged documents. An FIR was finally filed in 2019 — more than 20 years later! The officers sought anticipatory bail, but the Bombay High Court rejected it after keeping the case pending for nearly six years.
👉 What did the Supreme Court decide?
No Anticipatory Bail: The Court upheld the High Court’s decision, stressing that the gravity of the allegations, the officers’ official role in certifying fraudulent entries, their lack of cooperation, and the need for custodial interrogation outweighed the long delay.
Liberty & Delay Issue: More importantly, the Court strongly criticized the six-year delay in deciding the anticipatory bail plea. It said such long pendency is a direct attack on personal liberty, calling it like a “sword of Damocles” hanging over the accused.
Directions to All High Courts: The SC directed that bail and anticipatory bail pleas must be decided quickly — ideally within 2 months — and not left pending indefinitely. High Courts and subordinate courts must give liberty cases top priority.
