As we move into 2025, and a new administration moves into the nation’s capital, questions abound regarding the future of the U.S. Department of Education’s regulatory agenda for institutions of higher education. Please join us on January 31 for a live, 90-minute webinar during which Aaron Lacey, Co-Chair of Thompson Coburn’s Higher Education practice, will examine the status of the many new rules and policies that were advanced over the last four years. He will begin by discussing the anticipated composition and regulatory priorities of the new administration. Next, Aaron will walk through significant rules and policies issued by the Biden administration (e.g., borrower defense, financial value transparency, and gainful employment, financial responsibility, distance education), in each case discussing the state of the rule, pertinent litigation, and its anticipated fate under the new regime. Finally, he will speculate regarding future rulemaking activity and policy revisions, discussing likely timelines for negotiated rulemaking, proposed and final rules, and implementation, and highlight likely continuing challenges (e.g., the electronic application, agency resource constraints).
