Members of both the Property & Estates and Family Group, Hamish Dunlop, Louise Worton and Rachel Bale, joined together to consider co-habitee and co-owner rights, correct procedure under Civil Procedural Rules, pitfalls to avoid and other issues under the Trusts of Land and Appointment of Trustees Act 1996.
Our specialists also reflected on how ToLATA issues can often arise in Family Proceedings including the use of intervenors and consider the interface between this act and Schedule 1 claims. This recording includes a discussion as to cost implications and the increasing pressure from the courts in relation to the use of mediation and other forms of ADR.
