The 42 CFR Part 2 ("Part 2") regulations protect the confidentiality of substance use disorder (SUD) treatment records. Part 2 protects "records of the identity, diagnosis, prognosis, or treatment of any patient which are maintained in connection with the performance of any program or activity relating to substance abuse education prevention, training, treatment, rehabilitation, or research, which is conducted, regulated, or directly or indirectly assisted by any department or agency of the United States." Confidentiality protections help address concerns that discrimination and fear of prosecution deter people from entering treatment for SUD.
Objectives:
Participants will understand the requirements of 42 CFR Part 2.
Participants will learn how to apply the requirements of 42 CFR Part 2 in clinical practice.
About Your Instructor:
Lucy Hodder, JD, directs the health law program and is a distinguished visiting professor of law at UNH Franklin Pierce School of Law as well as an ongoing consultant in health law and policy at the UNH College of Health and Human Services (CHHS), Institute for Health Policy and Practice (IHPP). Lucy is the founding director of the Health Law and Policy Programs at the law school and IHPP.
Lucy is an experienced regulatory attorney of over 30 years. Prior to academia, Lucy served as Legal Counsel to New Hampshire Governor Maggie Hassan and her Senior Health Policy Adviser, working with the Governor on initiatives to expand access to health, mental health and substance use disorder coverage and services. Lucy was a shareholder at Rath, Young and Pignatelli, P.C, and Chair of the firm’s Healthcare Practice Group for many years after serving as an Assistant Attorney General for the NH Department of Justice. Lucy began her career as an associate at Brobeck, Phleger and Harrison in San Francisco. She clerked for Martin L.C. Feldman, United States District Court, New Orleans, Louisiana.
Lucy serves on the Boards of Concord Hospital/Capital Region Health Care, NH Public Radio and the NH Book and Literary Festival, Inc., and serves as an advisor to the NH Medical Society. Lucy is an appointed member of the NH Insurance Department’s Behavioral Health and Addiction Services Advisory Committee since 2016.
