I get calls from clients all the time asking me how they can be successful in getting a divorce. So, I thought I’d write up a quick guide on how to navigate the process of finding a divorce attorney in Texas.
I’ll start by explaining what divorce is and why it happens. I’ll also give you some tips for avoiding common mistakes that people make when filing for divorce, like mailing documents too late and making assumptions about the other person's financial situation.

Once we have covered those basics, I’ll go over some of the more specific problems that need to be addressed during the divorce process and offer some guidance for those problems. For example, what documents you need to send, what questions you should ask your client before signing anything, etc.

Finally, I will go over my personal experience working with clients and provide my recommendations for who should hire me as their lawyer if they are considering filing for divorce in Texas. The Texas Divorce Process

My name is Lisa Bustos, and I am a family law attorney in Austin.

Texas has some of the most amicable divorce laws in the country. To help you navigate this process, I have compiled some of the most common questions about divorce and what you need to do to prepare.

What is Family Law?

In the last few years, there has been a lot of talk about the differences between family law and divorce law — or at least, between “what is family law” and “what is divorce law”.

This blog post will try to be comprehensive and clear on what is, what isn’t, and why it matters.
A big part of the reason for this is that, in many cases, what you think of as divorce law can be very different from what you think of as family law. For example:
• When does marriage end? When both parties want out!
• Are women automatically entitled to alimony ? Absolutely not!
• Are children automatically entitled to live with both parents ? No way!
• When does a child become a dependent? At birth!
• Is alimony taxable? Yes – but only when the spouse earning it actually pays it!

(The IRS has a rather complicated system they use to determine if alimony payment qualifies as taxable income.)

So, before we start talking about how to resolve these different realities… let’s just talk about why this matters: challenging family court cases in Texas can have major consequences on your life. You could lose custody of your children while they are still minors, or you could lose custody of them after they are grown up enough to move out on their own.

You may have suffered emotional distress due to psychological trauma caused by an abuser (or an abusive relationship), or you may have suffered physical abuse by someone else who was trying to get back at your husband for something he did (or did not do).

You may find yourself with no legal recourse if someone accuses you of being unfaithful with your husband (or whoever he was), even though you absolutely were not unfaithful . . . because you were simply following accepted norms when it comes to marriage and breaking up marriages in Texas. . . even though that means that you didn’t know any better than everyone else when it comes to how long children should live with both parents before becoming dependent (and later, independent) – even though that means that some people in difficult marriages feel like they don’t deserve their daughters because they didn’t raise them right (even though some girls don’t get raised right anyway). And so on… it goes on ad infinitum… one person’s problem is another person’
