What happened: Why House didn't receive 2nd, 3rd impeach complaints vs Marcos | DZMM TeleRadyo

A constitutional law expert on Friday questioned why the Office of the House Secretary General refused to receive the second impeachment complaint against President Ferdinand Marcos Jr. while also explaining why the 3rd impeachment complaint could be rejected.

Atty. Domingo Cayosa said the second complaint filed by ex-lawmaker Teddy Casino and members of the Makabayan bloc had both a verified complaint and congressmen endorsing it.

“‘Yung pangalawa merong verified complaint at merong congressman na nag-eendorso nito so it is ministerial for the Office of the Secretary General na tanggapin ito at i-refer kaagad sa Speaker,” he said in a DZMM interview.

Earlier reports said the second impeachment complaint was not received because House Secretary General Cheloy Garafil is currently abroad.

"'Yung rason na hindi pwedeng tanggapin dahil wala ang Secretary General dahil nasa Taiwan ay hindi sapat na rason,” Cayosa said.

“Yung civil service rules malinaw na kahit aling opisina ng gobyerno pwede ‘yung next in rank para magtanggap. Kahit receiving clerk pwede na,” he added.

On the other hand, a third impeachment complaint filed by ex-lawmakers Michael Defensor and Jacinto Paras, lawyer Ferdinand Topacio, and Manuelito delos Reyes Luna was rejected also because of the absence of the House Secretary General.

Cayosa said the Secretary General cannot receive the complaint because no congressman endorsed it.

“Requirement ‘yan sa Constitution. A verified complaint must have the endorsement of at least one congressman,” Cayosa said.

“There is nothing to receive kung wala kahit isang congressman na mag e-endorse.”
