🔹 Major Gujarat High Court Highlights:
Financial Capacity in Cheque Cases:
In Mehta Nileshkumar Vishnuprasad vs. State of Gujarat, the Court held that a complainant does not need to prove financial capacity unless specifically challenged by the defense. Only then must the complainant show evidence of the funds loaned.
Conviction for Dishonoured Cheque:
In Nitin Vrujlal Kakkad vs. State of Gujarat, the High Court found deliberate intent not to pay the cheque amount issued against established legal dues. The accused failed to show any contrary documentary proof.
Condonation of Delay:
