Immigration authorities have long invoked INA § 235(b) to justify the detention of noncitizens entering the United States. But the reach of § 235(b) has exploded in recent months under the second Trump administration, as the government seeks to subject more people to detention without a bond hearing and sharply increase the use of expedited removal.
The webinar is aimed at legal advocates who represent clients who are, or could be, detained under INA § 235(b). We will discuss who the government is currently attempting to detain under § 235(b), arguments in Immigration Court about who is still eligible for bond hearings despite recent BIA precedent, and where individual habeas petitions as well as systemic challenges in federal court have been successful.
