In Utah, stepparents face a harsh legal reality after divorce: you don’t have automatic visitation or custody rights. Under Utah Code § 81-9-402, only in rare and very fact-specific situations can a non-parent secure visitation or custody and the burden of proof is extremely high. Courts will only consider it if you can show, with clear and convincing evidence, that you stepped into a parental role, formed a strong bond, contributed financially, and that cutting off contact would harm the child. Even then, this usually applies only when a parent is absent, unfit, or abusive.
So what can you do if you want to stay in a child’s life after divorce?
✅ Lead with respect for the parent’s authority
✅ Ask for small, specific, reasonable contact (a call, school events, occasional visits)
✅ Keep communication calm, short, and child-focused
✅ Put informal agreements in writing to avoid misunderstandings
And what not to do? Don’t threaten court, don’t guilt the child or the parent, don’t show up uninvited, and don’t try to “buy” access. Litigation is rarely the solution—trust and cooperation are.
