Trevor Potter and Paul Smith have spent their professional careers at the intersection of politics and law. Trevor is President of the Campaign Legal Center (CLC), a former Chair of the Federal Election Commission and general counsel to Senator John McCain’s 2000 and 2008 presidential campaigns. Paul, CLC’s Senior Vice President and Georgetown constitutional law professor, has argued 21 cases before the Supreme Court and served as President of the American Constitution Society.
The 2024 presidential election witnessed a surprise. Election law litigation was aborted by President-elect Donald Trump’s decisive victory. Abraham Lincoln once said:
“At what point then is the approach of danger to be expected? I answer, if it ever reach us, it must spring up amongst us. It cannot come from abroad. If destruction be our lot, we must ourselves be its author and finisher. As a nation of freemen, we must live through all time, or die by suicide.”
The price of liberty—of self-government—is eternal vigilance. Statesman Benjamin Franklin explained that the constitutional convention had given birth to a Republic, not a monarchy, “if you can keep it.”
