Explaining one of the most important doctrines in oil and gas law: the rule of capture. Why courts adopted this background rule, which says that if you produce oil on your land, it belongs to you, even if it was originally lying under your neighbor's land. (If you've seen There Will Be Blood, it's the "I drink your milkshake principle.")
This video also considers how this principle applies to hydraulic fracturing, considering the famous 2020 Briggs case from Pennsylvania and the famous 2008 Garza case from Texas.
