The two main reasons family law cases go to trial are those surrounding disputes of finances and custody.
In financial disputes, the two parties fail to see any middle ground, with one side demanding one amount and the other another amount.
The more money on the line, the more value bringing the issue to trial has. If the parties are only a few hundred dollars a month apart on child support or alimony, it generally does not make sense to go to trial – you would end up spending something like $30,000 to $50,000 to finance the trial.
However, in other instances, it may be worth it to not compromise and bring the issue before a judge, especially if the other side is unreasonable.
Likewise, parties involved in custody cases are often rigidly adamant of their desire for or entitlement of custody.
Courts have various ways of sharing custody that aim to be as fair as possible. They may have the amount of time with each parent change week by week, rotating between eight to six days and six to eight days every other week, for example. Other proposals give one parent more time when the children are off from school to make up for them not being able to help the children as much when they are in school. Still, many are not open to entertaining any of these options. In these cases, the only way resolution is possible is to go to trial.
