3 EU Passports, Still No Residence Card? The Shocking Truth in Germany
1. Our Family Situation
We are a family of five — three of us hold European Union passports, and the other two are Pakistani citizens. You’d think that with the majority of our family being EU citizens, getting residence cards in Germany would be easy. But unfortunately, that hasn’t been the case. What we thought would be a straightforward process turned into a confusing and frustrating journey through bureaucracy.
2. The German Immigration System Isn’t Simple
Germany is known for its strong legal structure and organized systems, but when it comes to immigration — especially for families with mixed passports — the process can be extremely slow and unclear. We quickly learned that being related to an EU citizen doesn’t always guarantee a smooth path to residency, especially if you’re applying under German national law rather than EU freedom of movement rules.
3. EU Rights vs. German Law
One of the biggest surprises for us was learning that the rules change depending on which country your EU passport is from. If the EU family member is German and you live in Germany, then you’re subject to German law, not EU law. But if the EU family member is from another EU country (like France, Italy, or Spain), and moved to Germany, then EU law protects their non-EU family members more strongly. This difference can make or break your application process.
4. Documents, Delays, and Disappointment
From collecting apostilled documents to booking appointments at the Ausländerbehörde (Foreigners Office), the whole system felt unnecessarily complex. Waiting months for appointments, having documents rejected for minor translation issues, and feeling like we were in legal limbo — it took a toll on us emotionally and financially. And we’re not the only ones — many families face the same struggles but don’t speak out.
