A search conducted at the petitioners' residence under Section 67 of the Central Goods and Services Tax Act revealed significant amounts of cash in different bedrooms. The lack of satisfactory explanations or evidence regarding the cash's source led the revenue to seize it, suspecting unlawful activities or improper accounting. However, in line with judicial precedents, the revenue has been directed to refund the seized money with interest within a week.

The petitioners, residing in the same building on separate floors, sought the release of the seized amount of Rs. 1,15,00,000/- by respondent no. 2. Despite repeated requests, the cash hadn't been released.

Citing earlier court decisions, the petitioners argued against the seizure of cash under Section 67, finding support in legal precedents (Deepak Khandelwal Proprietor M/s Shri Shyam Metal v. Commissioner of CGST, Delhi West & Anr. and Rajeev Chhatwal v. Commissioner of Goods and Services Tax (East)).

In response, the court directed respondent no. 2 to refund Rs. 14,50,000/- along with accrued interest to petitioner no. 1's bank account and Rs. 1,00,50,000/- along with accrued interest to petitioner no. 2's bank account. The petitioners are required to furnish bank account details within a week, and the respondents are to remit the amounts within two weeks thereafter.

This ruling does not prevent the Income-tax Department or any other authority from taking further action regarding the possession of such cash, ensuring compliance with relevant statutes.
