GROUP 5 – CHARGES / JOINDER OF OFFENCES / COURT JURISDICTION (5)
A. Joinder of Offences in One Year
(i) Jan/Feb 2024 -A person within a period of one year committed theft, cheating and trespass. Which court has jurisdiction to try the case and what will be the punishment?
(ii) Aug/Sep 2024- A has committed theft, trespassed and robbery at different places. What is the procedure to frame charges against him under CrPC?
B. Combined Serious Offences
(iii) Aug 2023 -A committed robbery, extortion, murder during night at 2.00 am. State how to file a criminal case and which court is having the power to take up the case and what will be the punishment?
(iv) Jan/Feb 2017 – A B C and D were charged for the offences of murder and robbery. All the four said that their intention was only to loot and not to kill. State how to frame a charge.
C. Murder, Burning of Body, and Filing Procedure
(v) Jan 2020 -A Mouni baba, along with his subordinates, killed his manager Kishore. Kishore was lifted, killed, and the dead body was burnt to conceal the evidence. Advise the family members to file a criminal case.
GROUP 6– PROBATION OF OFFENDERS / FIRST-TIME / SENTENCING (5)
A. First-Time Offender Seeking Probation
(i) Feb 2025 - A killed his wife with a deadly weapon as she was involved in adultery. A pleaded that he committed the crime for the first time and asked to be released on probation. Decide.
(ii) Aug/Sep 2024- A killed B. A took plea that he committed the crime for first time. State whether A can be released on probation.
(iii) Jan 2019- X killed his wife by giving poison. He committed the crime for the first time. Can he be released on probation?
B. Mitigation – Confession and Reduced Sentence
(iv) Jan/Feb 2017- Z killed his wife by burning her because of dowry. A criminal case was filed against him. He admitted the guilt before the court and requested the court for reducing the punishment. State whether he can succeed or not, and under which section.
(v) Aug 2023 - A was charged for murder and rape of a girl aged 12 years. He was convicted with death sentence by the sessions court with the confirmation of High Court. He went for an appeal to the Supreme Court, it took nearly 25 years to come before the Supreme Court. Whether the sentence can be waived or not? Whether time-consuming proceedings will reduce the punishment?
GROUP 7 – DOWRY / DOMESTIC VIOLENCE / SECTION 498-A (3)
A. Dowry Death – Filing and Provisions
(i) Jan 2020- A woman along with her two girl children was set ablaze by her husband and her in-laws for dowry. Who can file a criminal case on behalf of the deceased woman and her children? How to frame a charge against the culprits? What are the provisions which attract such type of incident?
B. Domestic Violence – Attempt to Kill Wife
(ii) Aug 2023 - X, husband of Y, daily harasses his wife after consuming alcohol. One day in a drunken state he made an attempt to kill his wife. She decided to file a criminal case against her husband. Under which section can she file, by whom, and what will be the punishment for X?
C. 498-A – Accused Absconding
(iii) Jan/Feb 2017 -A criminal case was filed under section 498-A IPC, but the accused was absconding. The victim filed for survival. Advise her as she is illiterate.
GROUP 8 – ARREST OF JUDGE (SPECIAL POWER CASES) (2)
(i) Jan 2019- A Judge is involved in a murder case. Is a police officer having the power to arrest? Discuss.
(ii) Jan 2020 -A judge was involved in a corruption case, it was confirmed by the preliminary enquiry and he was arrested by the police. Whether police have powers to arrest the judge? If not, how to arrest the judge? Which court is having the power to arrest him, and what will be the punishment?
GROUP 9 – RIGHT TO COUNSEL / LEGAL AID (2)
A. Denial of Legal Representation
(i) Feb 2025 -An accused is denied the right to legal counsel during a trial. The accused claims this violates their constitutional right to a fair trial. Decide.
B. Indigent Accused – No Lawyer Provided
(ii) Feb 2021 -In a case of rape, the accused is indigent and not in a position to engage an advocate for his defence. The local Bar Association decided not to defend the accused by any advocate. The court convicted him without providing legal assistance. What is the effect on the judgment?
GROUP 10 – MISCELLANEOUS (GOLD SHOP / OLD PARENTS) (2)
A. Gold Shop – Empty Box Case
(i) Jan/Feb 2024 -Two persons entered a gold shop, took away a box consisting of some gold chains. After going home, they found the box empty. Both were arrested. Whether they had committed any offence? Which court has jurisdiction to try the case, and what will be the punishment?
B. Relief for Elders Thrown Out
(ii) Apr/May 2022 A and B were aged and infirm parents of C, who threw them out of their house. A and B want to seek relief. Advise them.
