Division III decided State v. Sweidan, 13 Wn. App. 2d 53 (2020), in April 2020, just before the pandemic. In Sweidan, the trial court had permitted a witness to testify over Skype from Michigan due to her being the sole caregiver for her ailing mother and being unable to leave Michigan for that reason. Jennifer Winkler, counsel on Sweidan, details the appellate decision and related case law. Ms. Winkler discusses the black-letter law and remaining unanswered questions in the wake of this important appellate case.
