UP Law prof: No law requires Ombudsman to publicize decisions, but office should be transparent

UP College of Law Assistant Professor Paolo Tamase explained that the Ombudsman is not required under the Constitution or Republic Act 6770 to publicize his or her decisions. He made this clarification while discussing former Ombudsman Samuel Martires’ decision to reverse the 2016 dismissal order issued against Senator Joel Villanueva by then-Ombudsman Conchita Carpio-Morales.

Recently appointed Ombudsman Crispin Remulla announced on Thursday his intent to implement the 2016 dismissal order against Villanueva, only to later learn that his predecessor had already dismissed the case, though the decision was not made public.

For Tamase, this raises an issue of transparency, which he believes may stem from the former Ombudsman’s misunderstanding of the office’s role as “Tanod Bayan” — a protector of the people — having instead placed greater emphasis on the privacy of those involved.

He also added that the Senate’s refusal to execute a decision should not prevent the Ombudsman from pushing for the implementation of rulings against corrupt officials and from asserting the full extent of its powers, particularly in protecting the public.
