Immediate Accountability and Human Rights
frustration and fear regarding Pakistan's internal actions and its potential impact on global stability, particularly concerning its links to extremism and the tragic situation in Balochistan, are views shared by various activists and security analysts.
The idea of the world intervening to dismantle or restructure the state to ensure peace and self-determination for regions like Balochistan raises complex issues under international law.
🌎 International Law and State Sovereignty
International law is currently structured around the principle of state sovereignty, which severely limits the ability of other countries or international bodies to intervene militarily or politically to break up a sovereign country.
Non-Intervention Principle: The UN Charter and other international agreements strongly prohibit intervention "in the internal or external affairs of any State," which includes attempts to alter a country's territorial integrity or political independence.
Creating New States: The creation of new states, as envisioned by breaking up Pakistan, is generally a mixture of fact and law. It requires the new entities to meet criteria like having a permanent population, defined territory, a government, and the capacity to conduct international relations (Montevideo Convention). Most importantly, secession from an existing state without consent is considered an act of intervention by any state that prematurely recognizes the new entity.
Exception: Threat to International Peace: The only recognized right of external intervention lies with the UN Security Council under Chapter VII of the UN Charter, which can authorize measures, including force, if a state's conduct is deemed a "threat to international peace and security." While Pakistan's actions concerning terrorism and nuclear security raise major global concerns, these are typically addressed through sanctions or diplomatic pressure, not military restructuring.
📢 The Call for International Action
The most realistic path for the international community to "help Balochistan" is through intensified political pressure, accountability, and conditional engagement. This is precisely what Baloch women activists like Aisha Baloch and Dr. Mahrang Baloch are urging.
1. Immediate Accountability and Human Rights
The UN human rights experts have repeatedly called for a shift in Pakistan's approach:
Criminalize Enforced Disappearances: International bodies urge Pakistan to criminalize this practice and ratify the International Convention for the Protection of All Persons from Enforced Disappearance (ICPPED).
Independent Investigations: Demanding the government establish independent and effective mechanisms to investigate the fate and whereabouts of missing persons, and prosecute military/intelligence officers responsible for human rights abuses.
Protection of Defenders: Ensuring the immediate release of detained Baloch human rights defenders and ceasing the use of counter-terrorism laws to suppress peaceful protest.
2. Focus on Root Causes and Reforms
Security analysts and development experts argue that to stabilize Pakistan and prevent the spread of extremism, the government must address the root causes of the Baloch insurgency:
Political Reconciliation: Initiating genuine political dialogue with nationalist parties and separatist groups, including accountability for past crimes to build trust.
Economic Equity: Implementing constitutional provisions (like Articles 158 and 172(3)) to grant Balochistan its due share of revenues from its vast natural resources.
Provincial Autonomy: Enforcing the spirit of the 18th Constitutional Amendment to ensure meaningful provincial autonomy and reduce the dominance of the federal security establishment.
The continued, peaceful struggle led by the women of Balochistan is the most effective tool for gaining international attention and pressure against the state's security-driven policy. Their demands for justice and dignity are what is keeping the cause alive on the world stage.
