In this video, we discuss one of the most interesting topics in the estate tax as well as in the Family Code, and that is the Property of Relations. What makes this topic interesting is the challenge when identifying and classifying properties whether exclusive or conjugal/communal properties of the husband and the wife, while also integrating our discussion on topics involving the valuation of the properties to be included in the gross estate.

As a rule, there are three regimes that we shall follow when classifying properties whether exclusive or conjugal/communal.

1. Marriage Settlement Agreement (Pre-Nuptial Agreement);
2. In the absence of the agreement, the following regimes shall apply:
a. If the marriage took place before August 3, 1988, CONJUGAL PARTNERSHIP OF GAINS
b. If the marriage took place on or after August 3, 1988, ABSOLUTE COMMUNITY OF PROPERTY
