At about 9am on 4 January 1921, the scouts reported the presence of a considerable force of military and RIC raiding in Ballydaly. An IRA squad based there immediately got into a position of defense. Retreat was out of the question as the only way out was occupied by the enemy.
Con was captured, tried by court martial and found guilty of having a revolver in his possession. He was executed at Cork Military Barracks, and was the first man in the campaign to suffer the death penalty for carrying arms.
