The Nelson Mandela Bay Municipality has launched a major push to recover millions of rands from former officials found liable for unauthorised, irregular, fruitless and wasteful expenditure. This follows a landmark Supreme Court of Appeal ruling confirming that municipal officials can be held personally accountable under Section 32 of the Municipal Finance Management Act for intentional or negligent financial misconduct. North-West University’s Prof. Kedibone Phago weighs in.
