The Supreme Court heard oral argument in Masterpiece Cakeshop v. Colorado Civil Rights Commission, which concerns whether Colorado’s anti-discrimination law violated a baker’s First Amendment rights to freedom of expression, speech, and exercise of religion when he refused to make a wedding cake for a gay couple. The law prohibits in commercial settings discrimination against a person based on several factors, including sexual orientation. David Mullins and Charlie Craig filed a complaint with the Colorado Civil Rights Commission (CCRC), which initially ruled that Jack Phillips violated the law by refusing to sell and bake a cake for the couple. Mr. Phillips appealed the commission’s decision in Colorado courts, but they, too, ruled in favor of Mr. Mullins and Mr. Craig.
The Court ruled 7-2 on June 4, 2018, the baker’s rights were violated by the CCRC. citing the commission’s negative treatment of Phillips' religious beliefs.
