Issue Summary:
I purchased an Apple Watch for Rs ****** under a policy promising a full refund over 12 months if I walked 15000 steps daily. I diligently met this requirement, walking 2.5 to 3 hours daily. However, HDFC ERGO rejected my claims on ****** without a valid reason and unilaterally terminated my policy, vaguely alleging fraudulent data manipulation without proof.
Key Violations by HDFC ERGO:
1. Violation of IRDAI Protection of Policyholders Interests Regulations 2017
HDFC ERGO failed to provide a specific reason or proof for claim rejection.
Ignored my request to compare Apple Health and HDFC ERGO app data.
2. Lack of Transparency - Non-Disclosure of Fraud Detection Criteria
Refused to share fraud detection methodology or data validation criteria.
Violates IRDAI Circular Ref IRDAI/LIFE/CIR/MISC/229/12/2020.
3. Unfair Trade Practice - Concealment of Material Terms
Retroactively applied undisclosed conditions such as requiring GPS tracking or heart rate monitoring.
Violates Section 2(47) of the Consumer Protection Act 2019.
4. Unlawful Policy Termination
Policy canceled without proving fraud, violating Section 45 of the Insurance Act 1938.
